Terms of Service

Please read these Terms of Service carefully before engaging WDRSC Water Damage Restoration LLC for services or using our website. By requesting our services or using our website at wdrsc.com, you agree to be bound by these terms. If you do not agree to these terms, please do not use our services or website.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and WDRSC Water Damage Restoration LLC ("WDRSC," "we," "our," or "us"), a limited liability company licensed to operate in the State of South Carolina.

By calling us, submitting a contact form, requesting a service visit, signing a service authorization, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Services

WDRSC provides water damage restoration services in Charleston, SC and surrounding areas including but not limited to:

  • Emergency water extraction and removal
  • Structural drying and dehumidification
  • Flood cleanup and remediation
  • Sewage backup cleanup and decontamination
  • Storm and hurricane damage restoration
  • Water leak detection using thermal imaging and moisture metering
  • Structural repairs and full reconstruction following water damage
  • Insurance documentation preparation and adjuster coordination
  • Commercial water damage restoration

All services are performed in accordance with IICRC (Institute of Inspection, Cleaning and Restoration Certification) standards, specifically the ANSI/IICRC S500 Standard for Professional Water Damage Restoration, and applicable South Carolina contractor regulations.

3. Service Agreement and Authorization

Before any restoration work begins at your property, you will be asked to review and sign a Service Authorization form. This form describes the scope of work to be performed, provides authorization for WDRSC personnel to access your property, and may include an assignment of insurance benefits (AOB) if you elect to have WDRSC bill your insurance carrier directly.

By signing a Service Authorization, you represent and warrant that:

  • You are the property owner or have legal authority to authorize work on the property
  • You have the right to authorize insurance claim filing if you request WDRSC to do so on your behalf
  • All information you provide regarding your property, insurance coverage, and the circumstances of the damage is accurate and complete to the best of your knowledge

Emergency stabilization work may begin prior to the execution of a full service agreement in situations where immediate action is necessary to prevent further damage, with your verbal authorization. A written service agreement will be executed as soon as reasonably practicable thereafter.

4. Payment Terms

Direct Pay

If you are paying for services directly without insurance involvement, payment is due upon completion of each phase of work (extraction/drying and reconstruction) unless alternative payment terms are agreed to in writing prior to commencement of work. We accept major credit cards, check, and bank transfer.

Insurance Billing

If you have authorized WDRSC to bill your insurance carrier directly through an Assignment of Benefits (AOB), we will submit all required documentation to your insurer and seek payment from the carrier for all covered services. You remain responsible for any applicable deductible, any amounts the insurance carrier determines are not covered, and any amounts above your policy limits.

Deductibles

Your insurance deductible is your financial responsibility and is not waived, discounted, or otherwise absorbed by WDRSC. Any arrangement purporting to waive an insurance deductible is improper under South Carolina law and is not offered or permitted by WDRSC.

Late Payments

Unpaid invoices that are more than 30 days past due may be subject to a monthly finance charge of 1.5% or the maximum rate permitted by South Carolina law, whichever is less. WDRSC reserves the right to pursue all available legal remedies for collection of unpaid amounts, including filing a contractor's lien on the property where services were performed.

5. Insurance Claims

WDRSC will assist you in preparing and presenting documentation for your insurance claim, including moisture logs, thermal imaging reports, damage assessments, and photographic evidence. Our role is to document and report the actual scope and nature of the damage. We do not guarantee that your insurance claim will be approved or that your insurer will cover any specific amount.

Insurance coverage determinations are made solely by your insurance carrier based on your specific policy terms and conditions. WDRSC is not a licensed public adjuster and does not represent you in a legal or licensed adjusting capacity. We can recommend licensed South Carolina public adjusters if you need representation in a claim dispute.

You should review your homeowner's insurance policy carefully to understand what events and types of damage are covered. WDRSC is not responsible for advising you on the adequacy of your insurance coverage.

6. Property Access

By authorizing service, you grant WDRSC and its employees and authorized subcontractors the right to access your property during reasonable hours for the purpose of performing the agreed restoration services, including daily monitoring visits during the structural drying phase.

WDRSC will take reasonable care to avoid causing unnecessary damage to your property during restoration work. In some cases, controlled demolition of building materials is necessary to access moisture or to allow proper drying. This is considered part of the restoration process and is authorized by your service agreement. We will discuss the scope of any necessary demolition with you before proceeding whenever it is safe and practical to do so.

You agree to maintain safe conditions at the property and to inform WDRSC of any known hazards, including asbestos-containing materials, lead paint, electrical hazards, or structural instability, prior to commencement of work.

7. Limitations of Liability

To the fullest extent permitted by applicable South Carolina law, WDRSC's total liability to you for any claim arising out of or related to our services shall not exceed the total amount paid by you to WDRSC for the specific services giving rise to the claim.

WDRSC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use of property, lost profits, loss of business opportunity, or damage to personal property not directly caused by our work, even if we have been advised of the possibility of such damages.

WDRSC is not responsible for pre-existing conditions, hidden defects, latent damage, or prior damage to your property that was not caused by our work. We are also not responsible for damage caused by mold, rot, or structural deterioration that existed prior to our involvement or that develops after drying is completed due to conditions outside of our control.

8. Warranties and Guarantees

WDRSC warrants that all restoration work will be performed in a workmanlike manner consistent with IICRC S500 standards and applicable industry practices. We guarantee that structural drying will be certified complete only when all affected materials have reached IICRC target moisture levels as documented in our daily monitoring logs.

Our workmanship warranty on reconstruction work covers defects in materials and labor for a period of one year from the date of completion. This warranty does not cover damage caused by subsequent water intrusion events, Acts of God, normal wear and tear, or misuse of the restored property.

This warranty is the sole and exclusive warranty provided by WDRSC. All other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, are expressly disclaimed to the fullest extent permitted by South Carolina law.

9. Dispute Resolution

In the event of a dispute arising out of or relating to our services or these Terms, the parties agree to first attempt to resolve the dispute through good faith negotiation. Either party may initiate this process by providing written notice of the dispute to the other party.

If the dispute is not resolved through negotiation within 30 days of written notice, the parties agree to submit the dispute to mediation administered by a mutually agreed mediator in Charleston, South Carolina before pursuing litigation. The cost of mediation shall be shared equally by the parties.

If mediation is unsuccessful, any litigation arising from these Terms or our services shall be brought exclusively in the state or federal courts of Charleston County, South Carolina, and you consent to the personal jurisdiction of those courts.

10. Website Use

Our website at wdrsc.com is provided for informational purposes and to allow you to contact us about our services. You agree to use our website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use of the website.

You agree not to:

  • Attempt to gain unauthorized access to any portion of our website or its related systems
  • Use automated tools, bots, or scrapers to collect information from our website without our written permission
  • Transmit any malicious code, viruses, or other harmful software through our website
  • Use our website to send unsolicited commercial communications
  • Misrepresent your identity or affiliation when contacting us through the website

We reserve the right to restrict access to our website to any person or entity that violates these terms of use.

11. Intellectual Property

All content on our website, including text, images, graphics, logos, photographs, and the overall website design, is the property of WDRSC Water Damage Restoration LLC or its content licensors and is protected by applicable United States and South Carolina intellectual property laws.

You may view and print pages from our website for your personal, non-commercial use only. You may not copy, reproduce, distribute, republish, transmit, display, or create derivative works from our website content without our prior written permission.

The WDRSC name and logo are trademarks of WDRSC Water Damage Restoration LLC. Nothing in these Terms grants you any right to use our trademarks, service marks, or trade names without our prior written consent.

12. Termination

You may cancel a scheduled service appointment at any time before our technicians arrive at your property. If work has already commenced, you may request that we stop work, but you will be responsible for payment for all work performed and materials used up to the time work stops, plus any costs incurred for demobilization.

WDRSC reserves the right to decline or discontinue services at any time if we determine that safety conditions at the property are unacceptable, if you breach any material term of your service agreement, or if we are unable to obtain reasonable cooperation necessary to perform the work properly.

13. Governing Law

These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. WDRSC operates under South Carolina Contractor License #123456 and complies with all applicable state and local regulations governing contractor services in Charleston County and surrounding areas.

14. Changes to These Terms

WDRSC reserves the right to update or modify these Terms of Service at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Changes take effect immediately upon posting to our website. Your continued use of our website or services after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
